Bodo ZDA ubile nevtralnost interneta?

S prihodom nove ameriške administracije se za nevtralnost interneta na drugi strani oceana pišejo slabi časi. Predsednik Združenih držav Amerike, Donald J. Trump, je namreč odločen porušiti vse dobro, kar je ameriški državni regulator za področje telekomunikacij FCC naredil v dveh mandatih Baracka Obame. Zaenkrat se sicer samo ugiba o potezah in ukrepih, a pri Wired so že opozorili, da prvi znaki niso pozitivni.

Last October, one of Trump’s FCC transition team members, former Sprint regulatory policy manager Mark Jamison, wrote an essay arguing that the FCC should be stripped of almost its authority other than managing radio spectrum licenses. “Most of the original motivations for having an FCC have gone away,” Jamison wrote. “Telecommunications network providers and ISPs are rarely, if ever, monopolies. If there are instances where there are monopolies, it would seem overkill to have an entire federal agency dedicated to ex ante regulation of their services.” (vir)

Trump je za vodjo regulatorja imenoval človeka, ki ima dolgo zgodovino nasprotovanja internetni nevtralnosti.

“For fans of net neutrality—that is, the principle that network providers shouldn’t discriminate between different kinds of content when delivering services to consumers—a nightmare scenario was that Donald Trump would name a Federal Communications Commission chairman who would gut the protection for neutrality. That scenario just came to pass with the appointment of Ajit Pai.” (vir)

A upanje ostaja.

Herein could like how net neutrality survives a Trump presidency. Trump himself has made a big deal out of promoting small business growth, and startup tech companies stand to gain the most from an official net neutrality position.

Upstart broadband providers might be best served by lobbying Trump directly to leave the regulations alone, or at least mostly intact. There’s some evidence that this might work, as the president-elect’s FCC transition team is not uniformly publicly opposed to the concept. (vir)

Kje je Evropa?

Tudi Evropa čuti premike. Dopolnitve slovenskega zakona o elektronskih komunikacijah odpirajo nova vprašanja o eksplicitnemu varovanju nevtralnosti interneta in nalogo prelaga na regulatorja in zainteresirano javnost. Evropska unija, ki je lansko leto na tnalu ukinitve roaminga žrtvovala dobro in jasno definirano nevtralnost interneta se sooča z vedno večjimi pritiski operaterjev, ki preizkušajo nova pravila in merijo dolžino verige, na katero so priklenjeni.

Najbolj aktualna je trenutno še vedno Nizozemska, ki ima zaenkrat najboljše definirano nevtralnost interneta in redno sankcionira operaterje, ki jo kršijo.

The Dutch Consumer and Markets regulator (AFM) on Friday ordered T-Mobile to stop offering a streaming music product which did not count toward customers’ data usage. The AFM said the practice, often called “zero rating” is a violation of Dutch net neutrality rules, because it puts rival services such as Spotify at a competitive disadvantage. (vir)

Hkrati se zaradi signalov iz ZDA opogumljajo tudi evropske izpostave ameriških operaterjev oziroma evropski operaterji, ki čutijo, da se situacija spreminja v njihovo korist. Zato je še toliko bolj pomembno, da se javnost vključi v sooblikovanje zakonodaje (spremembe lahko spremljate na portalu e-uprava) ter da del industrije, ki mu nevtralnost interneta koristi (vsi, razen telekomov). Ne smemo namreč pozabiti, da se je prva bitka za nevtralnost interneta končala z ugodnim rezultatom za večino udeležencev ravno zaradi glasno izraženih interesov večine.
